In July, ice cream manufacturers Ben and Jerry’s made a very public declaration that their many flavors of ice cream would no longer be sold in what they referred to as “Occupied Palestinian Territory,” an apparent referral to the West Bank and East Jerusalem; the two Jewish-Americans from Long Island, New York, said the decision would take effect at the end of 2022 when its contract with the current Israeli manufacturer and distributor expires. In 2011, the Israeli Knesset passed a law allowing civil lawsuits that demand compensation from those who call for boycotts against companies in Israel and West Bank settlements, and immediately following the Ben and Jerry’s announcement, Shurat HaDin led the legal battle against this latest BDS caper. In 2019, Shurat HaDin forced Airbnb to reverse its pro-BDS policy in the wake of a court settlement between the vacation rental company and a dozen American Jewish plaintiffs who had sued the company and has taken an active lead in the fight to make Ben and Jerry’s pay a dear price for becoming yet another woke pawn in the fight against the Jewish state. As a countermove, Shurat HaDin is registering the name “Judea and Samaria’s Ben & Jerry’s” with the Judea and Samaria’s Registry of Corporations. We notified Unilever, Ben and Jerry’s parent company, about our future steps. Unilever fought back, claiming that it had never relinquished its trademark and had no intention of doing so. We hope to have the opportunity to square off against Ben and Jerry’s in a courtroom. We intend to seize their trademarks and utilize their name and manufacture our own ice cream in every Israeli region they have withdrawn from. This battle is far from over.
